9. If the Airline cancels a flight and re-accommodates you on another flight, your original upgrade offer may be transferred to the new flight, subject to Business Class seat availability. If there are not enough seats to fulfill your accepted upgrade, any amount paid will be refunded to the credit card used for the payment, offset against any compensation due under applicable law. If your booking is transferred to a flight operated by another airline, the Airline cannot guarantee an upgrade. In that case, any amount paid for the upgrade will be refunded to the original credit card, with the same offset rules applying.
10. The Airline may accept your Offer at any time from 24 hours to 3 hours before the scheduled flight departure. If your Offer is accepted, your credit card will be charged the full amount immediately, and the Airline will issue an Upgrade for each passenger included in your original booking. The total amount charged will include all applicable taxes and fees associated with the Upgrade. Once issued, an Upgrade cannot be assigned, transferred, or partially transferred to another person or flight, except as specified here in.
11. Once your Offer has been accepted by the Airline, refunds, transfers, or exchanges will not be permitted, except under the following conditions:

• In cases where the Airline re-accommodates a passenger on another flight in the class of service of the original booking prior to the Upgrade.
12. For instant upgrades, voluntary refunds will be issued as a voucher for future use, and date changes are permitted based on the availability of the class of service.
13. Passengers may not be seated in the upgraded class of service due to circumstances caused by the Airline. This includes situations such as a change in the aircraft or a delay in a connecting flight that results in missing the upgraded connection. However, this does not apply if the issue was due to the passenger's actions.
14. If a passenger does not use their Upgrade, a refund will be processed once approved. The amount paid for the Upgrade will be refunded to the payment card used for the purchase. The refund will be offset against any compensation due under applicable legal regulations.
15. If refunds are approved, they will be processed in the currency used for the Upgrade charge. If a foreign exchange rate is necessary to complete the refund in the original currency, a generally accepted prevailing rate will be applied. This rate may be adjusted to account for any conversion and other fees that the Airline may impose. The refunded amount will not exceed the original charge for the Upgrade in the original currency.

18. The Airline does not guarantee specific seat assignments for passengers whose Offers are accepted and who receive an Upgrade.
19. Passengers on the upgraded sector are entitled to an additional free baggage allowance. The amount of free baggage a passenger may carry is determined separately and individually for each flight segment in accordance with the conditions and limitations applicable to the corresponding flight segment.
